Public Hearings
1. Rezoning #2010-003 – Mary Wolf
Consideration of a rezoning request, with proffers, by Ms. Wolf pursuant to Zoning Ordinance Article 16, Section 16.1, Procedures for amendment, to rezone 4.79 ac. from R-2 to Conditional B-1 and 2.15 acres from B-1 Conditional/R-2 to A-1 for the purpose of building a brewpub (restaurant and brewery). Property is located at 4300 Rockfish Valley Highway, Nellysford, identified as Tax Map #22-A-29 and is currently owned by Al and Sharon Stacey.
2. Final Site Plan #2010-003 – Helen Park (Board of Supervisor action not required.)
Consideration of a final site plan for a garage to be located on 5.283 acres at the corner of Thomas Nelson Highway and Morse Lane, Arrington, Virginia, Tax Map #76-10-3, in which vehicles will be stored on a long term basis. A Special Use Permit was previously approved for this use in the Agricultural, A-1 Zoning District.
3. Zoning Ordinance Amendments – Combining Conditional Use Permit and Special Use Permit Uses
Consideration of amending the current Zoning Ordinance to combine Conditional Use and Special Use Permit uses in Articles 2, 3, 4, 5, 6, 8, 8A, 8B, 9, 12, 18 and 22. The term “Special Use Permit” is used more generally than “Conditional Use Permit” and accomplishes the same purpose.

In accordance with Volume 3A, Title 15.2, Counties, Cities and Towns, of the Code of Virginia, 1950, as amended, and pursuant to Section 15.2-2204, Section 15.2-2285, Section 15.2-2310, and Section 15.2-4307, the Nelson County Planning Commission hereby gives notice that a Non-Public Hearing and a Public Hearing will start at 7:30 p.m., Wednesday, September 22, 2010 in the Board of Supervisors meeting room on the second floor of the Nelson County Courthouse located at 84 Courthouse Square, Lovingston, Virginia., for the following:
Non-Public Hearing
1. Special Use Permit #2010-004 – Adam H. & Kathryn E. Knott (Deferred by PC on June 23, 2010, postponed by applicant in July and August)
Further consideration of an application pursuant to Article 4, Section 4-1-3a of the Nelson County Zoning Ordinance to establish a summer camp on property located on Rocky Bottom Lane, Afton, Virginia, Tax Map #6-A-116, 116A, and 114C. The property is zoned Agricultural, A-1.

2. Final Subdivision – Jack A. and Kathleen Miller (Board of Supervisor action not required)
Consideration of a final subdivision plat submitted by the Millers to divide 16.11 acres into 2 lots consisting of 5.188 acres and 10.917 acres. Property is located at 1280 Walkers Mountain Road, Arrington, in the Walkers Mountain Subdivision, Tax Map #85-3-54.
3. Exception #9 – Phillip & Margaret J. Kerl
Consideration of an exception to Nelson County Subdivision Ordinance Section 4-4, Subsection D.3), Individual Septic Systems, Exceptions, to waive soil report requirements for family subdivision of 3.02 acres from 6.95 acres. Property is located at 4401 Wheeler’s Cove Road, Shipman, Tax Map #46-A-46A.
4. Class II Communication Tower, With Exceptions – Verizon Wireless – Site Name: Myndus
Consideration of an application for a Class II permit and related site plan for Verizon Wireless to construct a communication tower consisting of a 92 ft. metal pole and associated facilities. In addition, an exception to Section 20-7-2a of the Zoning Ordinance is being requested to reduce the minimum distance of 125% of the tower height to the nearest property line. Exception is also requested to Section 20-7-5k, Landscaping, to waive landscaping requirements. Property is located on State Route 624, Pine Trail, Lovingston, Virginia, and Tax Map #45-7-1, owner David L. Thomas.
5. Major Site Plan #2010-006 – Mountain View Brewery (Board of Supervisor action not required)
Consideration of a site plan submitted by Steve Crandall for a proposed production brewery to be located on 15 acres on Cooperative Way, Colleen, Tax Map #66-A-36.
Following the hearing, the Planning Commission may vote on a resolution or ordinance to adopt, modify, or reject an item. The items requiring Board of Supervisors’ review and approval will be forwarded for action by the Board, which may adopt a resolution or ordinance to approve, modify, or reject an item.
The Nelson County Board of Supervisors will hold a public hearing on October 12, 2010 at 7:00 o’clock P. M. on those items referred to it by the Planning Commission. The meeting will be held at the location listed above. The following item is scheduled to be considered:

Consideration of a request for a SUP, as described in Item 1 above.
2. Exception #9 – Phillip & Margaret J. Kerl

Consideration of an application for Class II Communication Tower, with exceptions, as described in Item 4 above.
